These terms apply when you use atleta.com.au, buy a digital program from us, or book a service with us. By placing an order or booking an appointment you agree to them. Please read the health disclaimer in section 3 carefully.
1. Who we are
Atleta Health & Performance Clinic (ABN 58 228 881 744) is operated by Neil Russell, an Accredited Exercise Physiologist (AEP) registered with Exercise & Sports Science Australia (ESSA), from a private clinic at Suite 26, 166A The Entrance Rd, Erina NSW 2250.
In these terms, "we", "us" and "our" mean Atleta Health & Performance Clinic. "You" means the person using the site or buying from us.
2. What we sell
We sell two things:
- Digital programs — the Longevity Playbooks and related PDF resources, delivered electronically after purchase.
- Clinical services — in-person exercise physiology consultations at our Erina clinic, and consultations by phone or video.
3. Health disclaimer — please read
Our digital programs are general exercise information. They are not a personalised clinical prescription, a diagnosis, or a substitute for individual medical or allied health advice. We have not assessed you, we do not know your history, and a program bought online cannot account for your specific injuries, conditions or medications.
Before starting any program you buy from us, you should:
- talk to your GP or treating practitioner, particularly if you have a known injury, a chronic condition, are pregnant or post-partum, or have not exercised recently;
- stop immediately and seek advice if you experience pain, dizziness, chest discomfort, shortness of breath or anything else that concerns you.
You take part in any exercise program at your own risk. Individual results vary and we do not guarantee any particular outcome. Where we describe what a program is designed to do, that is a description of its intent, not a promise of results for you.
Clinical services delivered in the clinic are different — those involve an individual assessment by an Accredited Exercise Physiologist and are tailored to you.
4. Orders and payment
All prices are in Australian dollars and include GST where applicable. Payment is taken at the time of order through Shopify's checkout. We do not see or store your card details.
An order is accepted when we send you an order confirmation. If we cannot fulfil an order — for example because of a pricing error or a technical fault — we will tell you and refund you in full.
We may change prices at any time. A price change will not affect an order you have already placed.
5. Delivery of digital programs
Digital programs are delivered by email and/or download link, normally within a few minutes of purchase. There is no physical shipment and no shipping cost.
If your program hasn't arrived, check your junk or promotions folder first, then email us at info@atleta.com.au and we will resend it.
6. Your licence to use our programs
When you buy a digital program you get a personal, non-exclusive, non-transferable licence to use it for your own training. You may print a copy for your own use.
You may not resell it, share it, upload it anywhere, distribute it to a club, team or client base, or use it to deliver services commercially, without our written permission. Coaches and practitioners who would like to use our programs with clients are welcome to contact us about a licence.
7. Intellectual property
All content on this site and in our programs — text, images, program design, exercise sequences, branding and the Atleta name — belongs to us or our licensors. Buying a program does not transfer any ownership to you.
8. Refunds
Refunds are covered by our Refund Policy, which forms part of these terms. Nothing in these terms limits your rights under the Australian Consumer Law.
9. Appointments
Bookings are confirmed by email. Our cancellation terms, including the 24-hour notice period, are set out in the Refund Policy.
Where your session is funded under Medicare CDM, DVA, private health insurance or a workers compensation scheme, you remain responsible for any gap or out-of-pocket amount. We will confirm that amount with you before your appointment. Rebate amounts are set by those schemes and can change.
10. Your account and information
If you create an account, you are responsible for keeping your login details secure and for activity under your account. You agree that the information you give us is accurate and current.
How we handle your personal information is set out in our Privacy Policy.
11. Marketing emails
If you subscribe or download a free resource, we may send you occasional emails about training, the clinic and our programs. Every email has an unsubscribe link and we will action it promptly.
12. Acceptable use
You agree not to use this site to do anything unlawful, to interfere with its operation or security, to scrape or copy it at scale, or to misrepresent your identity.
13. Third-party links and services
Our site links to third-party services — payment providers, booking software, and occasionally products we recommend. We are not responsible for their content or their terms. Where we have a commercial relationship with a third party we will say so.
14. Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
To the extent permitted by law, our liability for a failure to comply with a consumer guarantee (other than a guarantee that cannot be limited) is limited, at our option, to resupplying the service or program, or paying the cost of resupply. Beyond that, and to the extent permitted by law, we are not liable for indirect or consequential loss.
15. Changes to these terms
We may update these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order. The "last updated" date at the top tells you when we last changed them.
16. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
